These terms are for using the Vesper:Chat app. They sit on top of Apple’s standard Licensed Application End User License Agreement (the “Apple EULA”), which applies to every App Store app. If the two disagree, Apple’s applies to what it covers, and these apply to the rest.
Spaulding Labs gives you a personal, non-exclusive, non-transferable licence to install and use Vesper:Chat on Apple devices you own or control, for your own non-commercial use. You may not copy, sell, rent, reverse-engineer or pull apart the app or its characters, models or artwork, except where the law allows it.
The characters are made up. What they say is generated by a language model and can be wrong, strange or out of date. It is not medical, legal, financial, or any other professional advice, and she is not a person, a therapist or a replacement for one. If you are in crisis or in danger, contact local emergency services or a qualified person. Please do not rely on her for decisions that matter.
What you type or say to her stays yours. We claim no ownership of it, and we do not receive it (see the privacy policy). You give us no licence to it, because it never reaches us. If you switch on an outside model, that provider’s terms apply to what you send it.
The optional outside model connects you to services run by others: your own server, or a cloud provider using your own account and key. We do not run them and do not promise they will be available, work with Vesper:Chat, keep their prices, or keep their formats. You are responsible for their charges and their terms. Her voice, speech recognition, weather and model downloads likewise depend on Apple, Open-Meteo and Hugging Face being reachable.
Characters, clothes and the outside-model unlock are bought through the App Store. They are handled and charged by Apple, and refunds are governed by Apple’s rules, not ours: all sales are final except as the App Store rules or the law allow you to ask Apple for a refund. Use Restore Purchases (SYSTEMS › SHIP) to get them back on a new phone or after a reinstall.
Use the app lawfully. Do not use it to harm or harass anyone, or to try to break or misuse the app. The app is for adults only: you must be 18 or older to use it, and the app asks you to confirm this the first time it opens.
The app is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. It runs a large language model on your phone, which can be slow, hot or wrong, and we do not promise it will be uninterrupted or error-free.
To the fullest extent the law allows, Spaulding Labs is not liable for indirect, incidental, special or consequential damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app in the twelve months before the claim, or US$50 if you paid nothing. Some places do not allow these limits, and then they apply only as far as the law lets them.
We may update these terms and the app. Using the app after an update means you accept the new terms. You can stop at any time by deleting the app. We may stop offering it.
These terms are governed by the laws of [STATE], United States, without regard to conflict-of-law rules, except where your local consumer law says otherwise.
